Short-Term Rentals

On October 25, 2022, the Santa Fe County (County) Board of County Commissioners (Board) adopted Ordinance 2022-07 to license and regulate Short Term Rentals in the County. Ordiance underwent amendments to address additional concerns and to refine the regulatory framework. these amendments were recorded on January 9, 2024, resulting in the updated Ordinance_2024-01_Re-recorded.

Beginning on Wednesday, November 30, 2022, the County’s Growth Management Office began accepting Short Term Rental applications via appointment.

There are situations where the property is not a legal lot of record or there is an unpermitted dwelling on the property and a permit, plat or variance is required. Upon submittal of a complete application for a variance, permit or plat, business owners will receive a temporary registration/license number that will allow them to continue to do business while their application is processed.

Owner-Occupied vs. Non Owner-Occupied

• Owner-Occupied: “a Dwelling that is the Owner’s primary residence or an Accessory Dwelling Unit that is located on the same legal lot of record as the Owner’s primary residence” (3.6).
• Non Owner-Occupied: “a Dwelling that is not Owner-Occupied” (3.7).
